RETURN AND EXCHANGE POLICY
We want to summarize the most important:
Returns and exchanges ARE FREE of charge.
SECTION 1 – INTRODUCTION
The realization of any purchase through LAQSHOP implies however the acceptance of the general terms and conditions of access and use of Mariia Berezovskaia’s website, as well as of the present particular terms and conditions, without objection or reservation of any kind.
SECTION 2 – GENERAL INFORMATION
In compliance with the duty of information contained in Article 10 of Law 34/2002, of July 11, of Services of the Information Society and Electronic Commerce, the following data are reflected below: the owner of the web domain is Mariia Berezovskaia, with address for the same purposes in Calle Poema Sinfónico 25, 12A, CIF number: Y5294332E. Registered in the register of entrepreneurs, professionals of Madrid with assigned registration number 2022C3694330479V and 2020C3694330166A and the following economic activities: Group 599, section 2 and group 8499, section 1.

SECTION 3 – PURCHASE PROCEDURE
Once the purchase order has been completed, and before confirming taxes, the user will be presented with a summary of the order identifying the item purchased, its total price (transport and included) with each of the items broken down, and the shipping details of the order, so that the user can confirm the order by clicking on the button with the expression ‘Confirm payment’.
Purchases may be paid by credit or debit card through a REDSYS payment gateway (secure payments authenticated and verified by Visa, MasterCard SecureCode, J-Secure, etc.) or through PayPal. The charge will be made online, i.e. in real time, through the payment gateway of the corresponding financial institution.
Also, an automatic e-mail message of order confirmation will be sent to the address indicated by the user with a description of the order where the user will be informed prior to the completion of the purchase of the exact amount will contain the reference of the selected items, their name, size, color chosen, and price (including taxes), the associated shipping costs. The non-receipt of this message may be due to a temporary problem of communications on the network or a typing error in the email address provided.
SECTION 4 – PRODUCT AVAILABILITY
LAQSHOP shows the information of product references and available stock of products.
If for any reason it is not possible to supply any of the products included in an order, LAQSHOP will contact the user as soon as possible to inform him/her of this circumstance and will proceed to refund the amount paid for it. If the order contains more items, LAQSHOP will ask the customer whether or not he/she wants the order to be processed or prefers to cancel it.
If the unavailability of the product affects the entire order, LAQSHOP will refund the full amount paid for the order, including the shipping costs that would have been charged to it.
SECTION 5 – WARRANTIES OFFERED
The products marketed have the following warranties.
In any case and, unless proven otherwise, it will be understood that the products are in accordance with the contract provided that they meet all the requirements expressed below, unless due to the circumstances of the case any of them is not applicable:
1.They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer.
2. They are suitable for the uses to which the products of the same type are ordinarily destined.
3. Are suitable for any special use required by the consumer and user when he has made it known to the seller at the time of conclusion of the contract, provided that the latter has admitted that the product is suitable for such use.
4. They present the usual quality and performance of a product of the same type that the consumer and user can fundamentally expect, taking into account the nature of the product.
In cases of proven non-conformity of the product with the contract, https://laqshop.es will proceed – where appropriate and as appropriate – to repair, replacement, price reduction or termination of the contract.
The deadline for reporting a non-conformity will be the legal one, which is currently two months from the date of knowledge of the non-conformity. Once the consumer has duly reported the defective product, https://laqshop.es may request the consumer to send back the product in order to investigate the nature of the product defect before proceeding to take further action.
SECTION 6 – DELIVERY TIME
All our orders are delivered by a courier service, within approximately 2-5 working days from the time the goods leave our warehouse in the event that the order is destined for the Iberian Peninsula (see Clause 13).
SECTION 7 – PRODUCT RETURNS – RIGHT OF WITHDRAWAL
If You are contracting as a consumer, You may withdraw from the Contract at any time within 15 working days, counting from the day on which You received the product(s), without giving any reason. In such case, you will receive a full refund of the price paid for the product in accordance with our Returns Policy.
Your right to withdraw from the Contract shall apply only to those products that are returned in the same condition in which you received them. You shall have a legal obligation to take reasonable care of the product while it is in your possession. If you breach this obligation, we shall be entitled to claim compensation from you. You will only be liable for any diminished value of the product resulting from handling other than that established to determine the nature, characteristics and functioning of the product. The product must be in the same condition in which you received it, with no apparent signs of use, correctly labeled and in its original packaging. As soon as we receive the package we will proceed with the refund of the order.
We do not accept exchanges or returns of the Jewelry section or products that are within the section underwear, swimwear. Or, additionally, those products that due to their nature cannot be returned, may deteriorate or expire quickly, or are personalized, unless they are defective.
Our warehouse will take care of the delivery of the returned products, reserving the right to verify their integrity. Once the return has been accepted, we will proceed with the refund of the amount paid for the purchase of the returned products. We will make the refund using the same method of payment used by you for the initial transaction, unless you have expressly agreed otherwise. We may withhold the refund until we have received the product or until you have provided us with proof of return of the product, whichever is the earliest.
Our warehouse will be responsible for the delivery of the returned products, reserving the right to verify their integrity. Once the return has been accepted, we will proceed with the reimbursement of the amount paid for the purchase of the returned products, with the exception of the transport contributions.
This refund will be made by crediting the amount paid to the credit card used, or to the PayPal account.
In the case of purchase by credit card, the time of reimbursement will depend on the credit card used, and in any case will occur within two bank statements.
This provision does not affect the rights recognized to the consumer by the legislation in force.
SECTION 8 – EFFECTS OF CANCELLATION
To proceed to make product returns, you must -within seven working days of receipt of the order-, send an email to the address: email@example.com indicating the order number concerned as well as the product or products to be returned.
The administration of the site https://laqshop.es will then contact you to arrange home collection of the products.
Once the request to exercise the right of withdrawal has been received by the buyer and once in possession of the goods to be returned, LAQSHOP will proceed to examine the products received and then the return will be made.
SECTION 9 – RETURNS OF DEFECTIVE PRODUCTS – FACTORY OR TRANSPORT DAMAGE
If you are not satisfied with any of the purchases made and you consider that the purchased product presents a defective condition due to a factory fault, you should contact us via email to the address: firstname.lastname@example.org. Please provide as much information as possible about the product and the order placed. The claim in the event of receipt of a damaged product should be made as soon as possible, being necessary that it occurs within 24 hours of receipt of the order so that it can be covered by the transport insurance.
The collection of the returned products will then be arranged. With the exception of the defect or defect appreciated, each product to be returned must be unused and with all its labels, packaging and, where appropriate, documentation and original accessories that came with it.
If the product is returned without the original packaging, LAQSHOP reserves the right to refuse the right to return products in case of violation of the provisions of these particular conditions.
Once in possession of the returned goods, LAQSHOP will proceed to examine the products received.
Once the existence of a manufacturing defect has been verified and as long as the conditions previously indicated are met, LAQSHOP will proceed to process the replacement of the product with another of identical characteristics with the corresponding manufacturer or distributor.
If it is not possible to replace the product, LAQSHOP will inform the user of this circumstance and will proceed to pay the user the amount corresponding to the purchase of the product. Products returned for being defective will be refunded in full, including shipping costs and the cost incurred by you to make the return.
We will process the return as soon as possible and, in any case, within 30 days after having confirmed via email your right to be reimbursed.
SECTION 10 – USER CONDUCT
It is not allowed to use the LAQSHOP website for:
– fraudulent purposes, or related to crimes or illicit activities of any kind
– send, use or reuse illegal, offensive, abusive, indecent, defamatory, obscene or threatening material of any kind, or that involves a violation of intellectual or industrial property rights, including copyrights and trademarks, or confidentiality, privacy or any other right, or is otherwise injurious or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising, chain letters, mass mailings or any other type of “spam”.

SECTION 11 – ACCESS AND CONDITIONS OF USE
LAQSHOP has free and full access to all pages of the said website. In order to proceed with the purchase of items, you must first register as a user, once you have accepted the General Terms and Conditions. Once you have completed your order you will be able to see the status of your order through your Account, where you will have all the information about your order.
When using LAQSHOP, you are responsible for maintaining the confidentiality of your account information and password, and for restricting access to your computer to prevent unauthorized use of your account.
LAQSHOP reserves the right to deny any attempt to access the Website, terminate accounts, delete or modify content, or cancel orders in the event that you fail to comply with applicable law, these Terms and Conditions or any Special Conditions or other terms and conditions or policies.
SECTION 12 – SHIPPING COSTS
Shipping costs will depend on the total amount of your purchase, if the order amount exceeds 45,00€, in Peninsula and Balearic Islands, shipping costs are free.
The cost of shipping to the peninsula, Ceuta, Melilla, Balearic and Canary Islands is:
Orders of less than 45,00€.

The cost of international shipments is 14,95€.
SECTION 13 – SHIPPING AND DELIVERY OF THE PRODUCT
LAQSHOP exposes shipping service to any country in the world. Domestic shipments have an estimated delivery time of 2 to 5 working days. International shipments have an estimated delivery time of 5 to 7 working days.
